1. Introduction

Welcome to Battery Man UAE (“Battery Man”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your use of https://batteryman.ae/ and any services we provide, including on-site car battery replacement, jumpstart and towing in Dubai (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy.

2. Who May Use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company, you represent that you are authorized to accept these Terms for that company.

3. Key Definitions

• Site: our website at batteryman.ae.
• Booking: any request you make for our mobile services (phone, WhatsApp, web, or in person).
• Personal Data: information that identifies or relates to an individual (see Privacy Policy).
• User Content: reviews, messages, or other content you submit.

4. Communications

We may send you transactional messages (e.g., booking updates, invoices) and service-related announcements by SMS, phone, email, or WhatsApp. You may opt out of marketing emails anytime via the unsubscribe link or by contacting [email protected].

5. Bookings, Prices & Payments

• Quotations: Prices are shown or provided in quotes and may vary by vehicle, battery specification (AGM/EFB/standard), location, and availability.
• Authorization: You confirm you are the owner or have authority to authorize work on the vehicle and safe access to it.
• Payment: We accept card or cash on site (or other methods we make available). By paying, you warrant that the details provided are true and you are authorized to use the selected method.
• Title & risk: Title to supplied goods passes on full payment. Risk passes on delivery/installation.
• Refusal: We may decline or cancel a booking for suspected fraud, safety concerns, stock limits, or errors.

6. Cancellations & Refunds

• Before dispatch: You may cancel without charge by contacting us promptly.
• After dispatch/arrival: A call-out fee may apply where work cannot proceed for reasons outside our control.
• Goods: Unused, unopened batteries may be returnable within 7 days at our discretion (inspection required). Installed batteries are generally non-returnable except as covered by warranty or required by law.
• Services: Completed services are non-refundable except where required by law.

7. Warranty

Most batteries we install include a manufacturer warranty (often 12 months). Coverage, claim process, and exclusions (e.g., misuse, improper electrical accessories, repeated deep discharge, physical damage) are detailed on our Battery Warranty page. Claims may require diagnostic testing and proof of purchase.

8. Safety & On-Site Work

• You must ensure the vehicle is accessible and parked safely (where possible) and follow technician guidance during on-site work.
• We may decline service if conditions are unsafe or illegal (e.g., restricted areas, active traffic hazards).

9. Acceptable Use of the Site

You agree not to misuse the Site, including by: (a) violating laws or third-party rights; (b) attempting unauthorized access; (c) introducing malware; (d) scraping or automated data collection without consent; (e) interfering with security or performance; or (f) posting unlawful, misleading, or harmful content.

10. User Content (Reviews, Messages)

By submitting User Content, you grant Battery Man a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content for our business (e.g., showcasing reviews). You warrant you have rights to the content and it does not infringe others’ rights. We may remove content that violates these Terms.

11. Intellectual Property

The Site, trademarks, logos, text, design, and software are owned by Battery Man UAE or our licensors and are protected by applicable laws. You may not reproduce or use our IP without prior written consent.

12. Third-Party Links & Services

The Site may link to third-party sites or services (e.g., maps, payment processors). We are not responsible for their content, policies, or practices. Review their terms and privacy policies before use.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what Personal Data we collect and how we use it, including cookies and analytics.

14. Disclaimers

The Site and Service are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

15. Limitation of Liability

To the maximum extent permitted by law, Battery Man UAE will not be liable for indirect, incidental, special, consequential, or punitive damages. Our total liability for any claim relating to the Service shall not exceed the amount you paid for the relevant goods or services.

16. Indemnity

You agree to indemnify and hold Battery Man UAE and our staff harmless from claims, losses, and expenses arising from your misuse of the Service or breach of these Terms.

17. Suspension & Termination

We may suspend or terminate access to the Site or Service at any time, including for breach of these Terms or unlawful activity. Some obligations survive termination (e.g., IP, limitations of liability, indemnity).

18. Governing Law

These Terms are governed by the laws of the United Arab Emirates. If any provision is found unenforceable, the remaining provisions will remain in effect.

19. Changes

We may update these Terms periodically. Changes take effect when posted on this page. Your continued use of the Service means you accept the updated Terms.
